The Spouse or Common-Law Partner Open Work Permit (SOWP) program provides an invaluable opportunity for the spouses or common-law partners of certain temporary foreign workers in Canada to work for any employer, anywhere in Canada. This program supports family reunification and allows spouses to contribute to the Canadian workforce.

Eligibility Criteria for the Spouse or Common-Law Partner Open Work Permit Program:

The SOWP is available to the following individuals:

Spouses of Temporary Foreign Workers: Foreign nationals whose spouse is in Canada on a valid study permit or work permit may be eligible for the SOWP. Additionally, IRCC has introduced a temporary measure allowing spouses of all temporary foreign workers, regardless of job skill and wage, to apply for the SOWP.

Spouses Applying for Sponsorship: Foreign nationals who have applied to be sponsored by their spouse for permanent residency in Canada are also eligible to apply for the SOWP. This allows spouses to work while their sponsorship application is in progress.

How the Spouse or Common-Law Partner Open Work Permit Program Works:

Application Process: Eligible spouses or common-law partners can apply for the SOWP online through the Immigration, Refugees, and Citizenship Canada (IRCC) website or by submitting a paper application, if applicable. The application must include supporting documentation, such as proof of spousal relationship and the spouse’s valid immigration status in Canada.

Work Authorization: Once approved, the SOWP allows spouses or common-law partners to work for any employer in Canada, in any occupation, for the duration specified on the work permit. This provides flexibility and freedom in employment choices while residing in Canada.

Validity Period: The validity period of the SOWP typically corresponds to the duration of the spouse’s study or work permit in Canada, or the processing time of the sponsorship application, if applicable.
